PRIVACY & DATA PROTECTION POLICY This Privacy Policy describes how Foxy Art ("we", "our", or "us") collects, uses, and protects your personal information when you visit or make a purchase from www.foxyart.co.uk (the "Site"). We are committed to ensuring that your privacy is protected in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. 1.1 Information We Collect When you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information, email address, and phone number. We refer to this information as "Order Information.” 1.2 How We Use Your Information We use the Order Information that we collect to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to communicate with you and screen our orders for potential risk or fraud. 1.3 Secure Payments via Stripe All financial transactions and credit card processing are handled securely through our third-party payment gateway Stripe. Foxy Art does not store, retain, or have access to your full credit card details or raw financial credentials. Stripe processes your personal financial data securely in compliance with the Payment Card Industry Data Security Standard (PCI-DSS). 1.4 Automated Email Marketing Our website utilizes an automatic email marketing system. By completing a transaction, your email address may be securely registered to receive automated operational updates, shopping cart reminders and tailored promotional offers. You maintain the absolute statutory right to opt-out, unsubscribe, or manage your email preferences at any time via the "Unsubscribe" link embedded at the bottom of every marketing transmission. 1.5 Cookie Compliance & Tracking The Site uses tracking technologies and cookies to provide an optimized shopping experience, power our secure checkout integrations and manage automated email marketing queues. Cookies enable our servers to remember your cart preferences and your interaction history. You can adjust your personal device or web browser parameters to refuse cookies; however, doing so may disrupt certain secure checkout and transactional functions of the Site. 2. TERMS OF SALE & FULFILLMENT 2.1 Custom-Made to Order Infrastructure Every item offered on the Site is custom-made, hand-finished, or manufactured explicitly to order based on individual preferences. We do not maintain a pre-fabricated or off-the-shelf inventory. By placing an order, you acknowledge that your product will be custom-built according to the specific design, style, and size guidelines configuration selected on your invoice. 2.2 Manufacturing & Production Timeline Owing to the artisanal, handmade nature of our products (including our custom folklore, embroidery, and pop art collections), the standard manufacturing timeframe ranges between 1 and 5 business days from the moment payment is verified. This production baseline may fluctuate slightly during peak holiday seasons or high-volume sales periods. 2.3 Tracked Shipping & Delivery Timeline Because our custom shoes and products are built to order, please allow a tracked delivery window of 10–15 business days for your parcel to arrive directly at your specified delivery address. Once the dispatch occurs, a tracking link will be automatically issued to your registered email address. These delivery timelines are reasonable approximations and may occasionally be altered by third-party customs clearance or carrier anomalies. 2.4 International Customs, Tariffs, and Import Duties For purchases destined for international borders outside our primary fulfillment origin, all shipments may be subjected to local import duties, customs tariffs, clearance administration charges, or localized VAT assessments levied by the destination country. Foxy Art does not calculate, assume, or absorb these localized fees. All customs-related fiscal responsibilities remain strictly with the customer/buyer and must be settled upon delivery to release the package from local customs bureaus. 3. CANCELLATION, RETURN & REPLACEMENT POLICY 3.1 Strict 3-Hour Cancellation Window We operate an extremely rapid, automated fulfillment pipeline to ensure that custom shoes enter production swiftly. Consequently, customers are granted a strict 3-hour grace period from the exact timestamp of order placement to request a full, risk-free cancellation. All cancellation requests must be explicitly submitted in writing to foxy.art.co@gmail.com within this 3-hour window. 3.2 Post-3-Hour Order Cancellations Any cancellation request submitted after the 3-hour grace period will automatically be subject to a non-negotiable 30% cancellation fee. This 30% charge directly covers unrecoverable administrative processing costs, automated merchant gateway fees, and raw material allocations that are committed immediately when an item moves into custom manufacturing queues. 3.3 Statutory Consumer Rights Exception (Custom Goods) Under UK Consumer Contracts Regulations and e-commerce laws, the statutory 14-day "right to cancel" or "cooling-off period" does not apply to goods that are custom-made, personalized, or manufactured to unique specifications. Because all Foxy Art shoes are individually crafted to order, you do not have a legal right to return or exchange items due to a simple change of mind, taste, or alternative personal preferences. 3.4 Customer Sizing Liability & Errors Foxy Art manufactures footwear precisely according to the specific size requested by the customer during checkout. It is the customer's sole responsibility to consult our sizing guides and ensure the correct fit is selected. No refunds, partial refunds, returns, or free replacements will be granted under any circumstances if a customer orders an incorrect shoe size. 3.5 Foxy Art Sizing & Fulfillment Liability If the final delivered product displays a structural size configuration that is mistaken by Foxy Art (i.e., the physical size of the delivered shoe does not match the size clearly stated on the original purchase invoice), Foxy Art assumes 100% financial and operational liability. In this event, we will fully cover the cost of return postage by providing a prepaid shipping label, and we will manufacture and dispatch an identical replacement pair in the correct size at no additional cost to the customer. 3.6 Damaged, Defective, or Faulty Merchandise In accordance with your legal consumer rights, all items must be of satisfactory quality and fit for the purpose. If your custom merchandise arrives with a genuine material defect or manufacturing flaw (unrelated to sizing), you must report the issue within 14 calendar days after delivery. Claims must be submitted via email to foxy.art.co@gmail.com and must include clear photographic and/or video evidence documenting the defect. Upon validation, Foxy Art will arrange for a prompt complimentary replacement to be produced and shipped to you. 4. INTELLECTUAL PROPERTY & DESIGN RIGHTS All artistic designs, graphics, compositions, layout patterns, and footwear prints showcased on the Site are the exclusive intellectual property of Foxy Art. Our custom collections are originally designed and heavily inspired by the rich cultural history of Bulgarian folklore art and traditional geometric embroidery (Shevitsa), as well as contemporary UK pop art movements and "London Vybe" expressions. Any unauthorized replication, commercial exploitation, redistribution, or modification of our original artwork or website content without explicit written consent from Foxy Art is strictly prohibited and protected under UK and international copyright frameworks.
